These terms are the agreement between you and TMARK PRODUCTIONS for your use of EQExpert at eqexpert.app. By using the app you accept them. If you do not, please do not use it.
EQExpert translates plain descriptions of sound problems into specific things to try on a mixing console. It is a reference tool and a second opinion. It is not a person, it does not hear your room, and it does not know your gear.
Live sound involves loud amplified audio and equipment that can be damaged by the wrong setting. Feedback, high gain, and sudden level changes can harm hearing and blow drivers.
Every suggestion EQExpert makes is a starting point for you to judge. You are responsible for what you actually do to your system and for the safety of everyone in the room. If a suggestion does not fit what you are hearing, ignore it. Use your ears, protect your audience, and protect your gear.
You can use the free features without an account. Signing in uses a one-time link or code sent to your email, so keep access to that inbox secure. You are responsible for activity under your account. Tell us at info@markexproductions.com if you think someone else is using it.
One account is for one person. Please do not share sign-in links.
Some features are free and some require EQExpert Pro. We may move a feature between the two as the product develops. If something you already pay for moves behind a higher tier, we will not do that to you mid-subscription without telling you first.
EQExpert Pro is a subscription, billed at 5.99 US dollars per month or 48 US dollars per year, through Stripe. Prices include any tax where we are required to charge it.
It renews automatically at the end of each period until you cancel. You can cancel at any time from the billing portal in the app, and you keep Pro until the end of the period you already paid for. There is no cancellation fee.
If we change the price, we will give you at least 30 days notice before it applies to your renewal, and you can cancel before then.
If EQExpert Pro is not right for you, email info@markexproductions.com within 30 days of a charge and we will refund it in full. No explanation needed.
If you are in the United Kingdom or the European Economic Area, you also have a statutory right to withdraw within 14 days of subscribing. By starting to use Pro immediately you agree that we begin the service right away, and you may be charged for what you used if you then withdraw. In practice the 30 day refund above is longer than the statutory window and easier to use, and we will honour it either way.
Please do not: resell or redistribute the app or its content as your own, scrape or bulk extract the reference data, attempt to break the entitlement system or access another person's account, overload the service with automated requests, or use it for anything unlawful.
We can suspend or close an account that does these things. If we close yours for a reason other than a breach of these terms, we will refund the unused part of your subscription.
EQExpert, its content, its reference data, and its design belong to TMARK PRODUCTIONS. Using the app gives you a personal, non-transferable licence to use it, and nothing more.
What you write in the feedback box is yours. By sending it you give us permission to use it to improve the product, including quoting it internally, without any obligation to you. We will not publish your feedback in a way that identifies you without asking first.
We aim to keep EQExpert running and will not take it down casually, but we do not promise uninterrupted service. Hosting providers have outages, and we may take the app down briefly for maintenance. If it is unavailable for a long stretch and you are a paying subscriber, contact us and we will make it right.
We may change or remove features. If we retire something significant, we will say so in the app.
EQExpert is provided as it is. We do not warrant that its suggestions are correct for your room, your gear, or your situation, because it cannot know any of those things. It is a reference tool, and the judgement stays yours.
To the extent the law allows, TMARK PRODUCTIONS is not liable for damage to equipment, hearing loss, lost performance revenue, or any indirect or consequential loss arising from your use of EQExpert. Where we are liable, our total liability is limited to what you paid us in the 12 months before the claim.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all your statutory rights.
You can stop using EQExpert whenever you like, and cancel from the billing portal. We can end your access if you materially breach these terms, and we will tell you why.
If we change these terms we will update this page and move the effective date. For changes that affect your rights or what you pay, we will notify subscribers in advance.
These terms are governed by the laws of the State of Georgia, United States, and the courts there have jurisdiction. If you are a consumer in the United Kingdom or the European Economic Area, this does not deprive you of the protections of your local law, and you may bring proceedings in your own country.
